Coverage general terms and conditions

Definitions:

Beneficiary: The passenger who has acquaired iPax Bag Protection.

Luggage: Travelling bags, bags, bagpack or any other cas protected by iPax Bag Protection.

Start and termination of luggage coverage: From the time the luggage protected by iPax Bag Protection is placed within the airport of departure after having performed the check-in and having checked the luggage until the time the luggage is picked up at the airport of destination.

Assistance situation: Any event, situation or sircumstance contemplated in this coverage, which entitles a beneficiary to recieve assistance services.

Territoy of coverage: The beneficiary shall be entitled to the assistance services in any part of the world.

Term of coverage: The beneficiary may access any of the assistances while on a travel in which they have purchased the iPax Bag Protection service, outside their city or usual country of residence.

Asistence services^

Tracking and transportation of luggage of personal belongings: In the case of theft or loss of luggage porotected by iPax Bag Protection during local flights within the Republic of Argentina, or international flights departing from or arriving in the Republic of Argentina, Europ Assistance will assist the beneficiary with the filing thereof before the relevant air carrier. In the event luggage is located, Europ Assistance will coordinate the delivery thereof with an air carrier that will send the luggage to the place indicated by the beneficiary while such beneficiary is on travel or to their permanent residence.

Suplementary compensation for total loss of luggage: Should the passanger lose their whole luggage protected by iPax Bag Protection during the flight after the luggage has been checked and stroed at the regular airline’s storage room and should the same not be found, Europ Assistance will pay a suplementary monetary compensation in addition to the pay by the air carrier. The additional compensation payable by Europ Assistance shall be the required to supplement:

•U$S 10 per Kg. Up to a maximum of 60 Kg; until completing a maximum of U$S 600 on local flights with airlines within the Republic of Argentina.

•U$S 20 per Kg. Up to a maximum of 70 Kg, until completin a maximum of U$S 1.400 on international flights with airlines departing from or arriving in the Republic of Argentina.

•Te payment of U$S 10 per Kg. and U$S 600 as maximum limit, as well as U$S 20 per Kg. and U$S 1.400 as maximum limit, as applicable, is payed in conjunction with the amount payed by the airline plus the supplement payable by Eurpo Assistance.

•The amount of the supplement payed by Europ Assistance and the amount payed by the airlines will never exceed the U$S 1.400 maximum compensation limit. The U$S 600 or the U$S 1.400 limit corresponds to each traveling bag protect by iPax Bag Protection. Given that the compensation provided for herein is supplementary the following requirements shall be met to be entitled to Europ Assistance’s compensation:

[a]- The luggage should have been lost during transportation on a local flight with a regular airline carrier within the Republic of Argentina.

[b]- The luggage should have been lost during transportation on an international flight (flights departing from or arriving in the Republic od Argentina) with a regular airline.

[c]- The relevant luggage shuld have been duly checked at the indicated air carrier’s storage rooms.

[d]- The passanger must be entitled to compensation from the air carrier company.

[e]- The loss of the luggage should have occured between the time the luggage was submitted to the air carriers authorized stuff for its shipment and the time it was to be delivered to the passanger at the end of the trip.

[f]- The regular airline should have assumed liability for the loss of the relevant luggage and should have payed the relevant compensation to the passenger.

[g]- The loss of the checked luggage must be total, since there is no supplementary compensation in the event of partial loss; that is, it is applicable to the whole piece of luggage. There is no supplementary compensation either for breakage of luggage or its content. In the latter cases only the air company may assume liablity therefor, but there is no supplementary compensation payable by Europ Assistance for loss of content.

It is hereby stablished that given that Eurpo Assistance’s compensation is striclty supplementary to the regular airlines compensation, payment thereof shall be strictly contingent upon submittal to Europ Assistance of the avidence that the air carrier company responsible for the transportation has payed the relevant compensation. All persons not entitled to luggage transportation are expressedly excluded from this supplementary compensation.

It is a condition presedent to the right to this security that the passenger should have notified Europ Assistance of the loss and should have previosuly reported the loss to the airline within 6 hour from the loss occurrence (arrival at destination / report to air company).

Traveler referral assistance services

When a beneficiary suffers an emergency during a trip, they may contact Europ Assistance’s call center at the telephone numbers that appear on this brochure and request assistance and information regarding any of the following assistances services:

Medical referrals: Europ Assistance will provide beneficiary with information on their preferred health providers, including family practitioners, ophthalmologist, gynecologist, pediatricians, etc. The beneficiary will be given the providers name, address, telephone number and office hours. The nature of the situation, the location of the beneficiary and the time of the day will influence whether a referral is made to an individual provider or to a hospital or emergency care facility. Europ Assistance will also provide information on medical specialists in major cities an nearby areas using specific selection criteria. Sepecialists including allergists, cardiologists and endocrinologists, among others.

Dental referrals: Europ Assistance will provide information on dentists and facilities that provide emergency dental care in accordance with established selection criteria.

[1]- Prior to living the luggage claim area athe airport of destination, the beneficiary ust approach the airline’s counter to fill out the P.I.R. (Property Irregularity Report) form, putting forward therein that the lost luggage was treated with iPax Bag Protection. Lost document assistance (passports): Europ Assistance will assist the beneficiary with the necessary diligences to replace or forward lost or stolen documents, including passports, driver’s licences and credit card, and will assist in the procedures to report losses and recover lost or stolen items.

Legal advise services via telephone: Europ Assistance will provide beneficiary with primary legal advise for any criminal proceeding filled against beneficiary as a result of a traffic accident or any other situation arrising during the trip.

Urgent message rely: Europ Assistance will rely emergency messages to the beneficiary’s family related to an urgent medical assistance situation udergone by the passenger resultin from an accident or illness.

Instructions:^

[1]- Prior to living the luggage claim area athe airport of destination, the beneficiary ust approach the airline’s counter to fill out the P.I.R. (Property Irregularity Report) form, putting forward therein that the lost luggage was treated with iPax Bag Protection.

[2]- Later, the beneficiary must report the relevant loss to the airline and must claim the first compensation in the event of loss of luggage..

[3]- The beneficiary must contact Europ Assistance’s call center at [+ 54 11] 4814 9059 and report the loss of their luggage within 6 hours from having arrived at destination and after having fulfilled the first two steps above.

In the event of failure to fulfill the three steps sited above, Europ Assistance will resfuse to pay any type of requested supplementary compensation. Europ Assistancewill pay the supplementary compensation for loss of luggage subject to beneficiary’s submittal or forwarding of the following evidence:



• Tax ticket used by iPax Bag Protection.
• Passenger Assistance Code (PAC)
• Copy of the air ticket or boarding pass.
• Written statement from the air carrier putting forward that luggage was lost during trasportaion on a regular airline flight.
• Original reciept of payment of the relevant compensation payed by the air carrier.


Should any of such documents be omitted, the beneficiary shall not be entitled to claim any supplementary compensation, both befor iPax S.A. and Europ Assistance.

Lapse of term for claims: Any claim related to the loss of luggage must be filled with Europ Assistance within 6 hours from reporting thereof to the air carrier (arrival at destination), upon the lapse of which term no legal action may be filed.

Europ Assistance shall not be layable for any possible banking charges that may arrise at the time of transferring the supplementary compensation to the beneficiary. Should any such charges arrised, they shall be discounted from the relevant payment.

Subrogation: In the event the services provided by Europ Assistance are covered, in whole or in part , by an insurance policy or coverage other than that of Europe Assistance, Europ Assistance Argentina S.A. shall subrogate to the rights and remedies of the passenger under such policy. For this purpose, the passenger shall cooperate in full, and this shall not purport any liability whatsoever incured by the company.

Exclusions:^

[a]- The beneficiaries shall be entitled to a reinboursement by Europ Assistance for the loss of their luggage only if they have notified thereof to Europ Assistance within 6 hours from having arrived at the airport of destination and upon recieving the autorization from Europ Assistance..

[b]- All sanitary medical expenses deriving from the information provided by Europ Assistance at the beneficiary’s request. In all cases, Europ Assistance’s service shall be restricted to providing sanitary medical information, an Europ Assistance shall not be responsible for payment thereof.

[c]- the requested information that originates from assistance situations as a direct or indirect consequence of:

1.-War, invations, acts of foreign enemies, hostilities (wheteher war has been declared or not) civil war, revolt, insurrection, terrorism or serition, demonstrations and / or popular movements.

2.-Self injuries or the engagement of beneficiary incriminal acts, fights and combats, except in the event of self defense.

3.-Mental illnesses or psycological disorders.

4.-Illnesses or patological conditions caused by the voluntay ingetion or administration of toic substances (drugs), narcotics or the use of unprescribed medication.

5.-Suicide illnesses and injuries as a result of an attept to commit suicide.

6.-Payment of fines or administrative penalties.

7.-Compensation for carry-on luggage carried by the beneficiary in the airplane’s cabine and all pieces of luggage not protected by iPax Bag Protection.

8.-Compensation for loss of jewelry, cash, watches, credit cards, travellers checks, financial instruments, item collections, electronic devices ( laptop / palmtop / cameras, recorders, cell phones, etc.)

9.-Any tipe of expense for the purchase of basic goods, acommodation and any other expense related or unrelated to the loss of luggage.

10.-Medical Mal Practice.


All sanitary medical, dental, legal, documentation-related and telephonic expenses deriving from the coordination conducted by Europ Assistance at passenger’s request shall be payed by the traveller and not by iPax S.A. or Europ Assistance, because in all cases Europ Assitance’s service shall be limited to providing information on the above site dservices and to coordinating referrarls and transfers, and, therefore, shall not be responsible for the payment thereof. Far there more, it is a hereby expressly stated that in any case that Europ Assistance should pay any expense as a result of the above sited services, coordination or transfers, they may not ask for the repetition of susch amount from iPax S.A. on the grounds that such services are included in the coverage rendered by Europe Assistance, in agreement to the forth covenant of the service agreement.

IN NO CASE IPAX S.A. BE LIABLE IN THE EVENT OF MAL PRACTICE, MALICE, WRONG PROVITION OF THE SERVICES RENDERED BY EUROP ASSSISTANCE OR THIRD PARTIES TO THE PASSENGER, FOR IPAX S.A. OFFERS THE PASSENGER PAYING FOR IPAX BAG PROTECTION’S SRVICE A COMPENSATION FOR THE TOTAL LOSS OF THE LUGGAGE, AS WELL AS TELEPHONE ASSISTANCE, BUT IN NO CASE SHALL IT BE LIABLE FOR ANY RESULTING DAMAGES.
